Terms of Use & Privacy Policy

By accessing, browsing, or otherwise using the Site, you represent that you are at least the age of majority in your jurisdiction (or have a parent/guardian’s consent), that you can form a binding contract, and that you will comply with these Terms and all applicable laws.

• “Content” means all data, statistics, ratings, metrics, models, charts, visualizations, text, design, and other materials made available on the Site.
• “Derived Metrics” means our original analytical outputs (e.g., expected goals, RAPM, GAR, finishing-variance, percentile cards), as distinct from underlying public facts.
• “You” means the individual or entity accessing the Site.

Subject to your continued compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and view the Content for your own personal, non-commercial use only. No other right or license is granted, whether by implication, estoppel, or otherwise. We reserve all rights not expressly granted.

Except as expressly permitted in writing by us, you agree that you will not, and will not permit any third party or automated agent to:

• sell, rent, lease, sublicense, redistribute, republish, syndicate, or otherwise transfer or make available the Content to any third party; the Content is not for resale;
• scrape, crawl, spider, harvest, bulk-download, cache (beyond ordinary browser caching), or use any automated means, bot, or data-mining tool to access, extract, or copy the Content or any substantial or repeated portion of it;
• use the Content, in whole or in part, to build, train, fine-tune, populate, or operate any product, service, model, dataset, or database that competes with or offers functionality substantially similar to the Site;
• access the Site through any interface other than the one we provide, or use any API, framing, mirroring, or deep-linking to present the Content as your own or out of context;
• reverse engineer, decompile, or attempt to derive the source code, models, or underlying methodology of the Content;
• remove, obscure, or alter any copyright, trademark, attribution, or other proprietary notice;
• circumvent, disable, or interfere with any access control, rate limit, security, or paywall feature;
• impose an unreasonable or disproportionately large load on our infrastructure, or interfere with the proper working of the Site;
• present the Content as official, endorsed by, or sourced from the NHL, NHLPA, any team, or any data provider; or
• use the Site for any unlawful purpose, to provide wagering advice or operate a gambling service, or in violation of any applicable law or third-party right.

Violation of this Section is a material breach that immediately terminates your license. We may investigate and pursue all available remedies, including blocking access and seeking injunctive relief.

The underlying facts reflected in the Content (such as game events, shot coordinates, and contract terms reported publicly) are facts and are not owned by anyone. However, our Derived Metrics, their selection, coordination, and arrangement, and our compilation as a whole are our original intellectual property, protected by applicable law, and are licensed (not sold) to you. All trademarks, logos, and team marks are the property of their respective owners; their appearance on the Site (where applicable) is nominative and does not imply affiliation or endorsement.

The Site may display or link to third-party materials (for example, player photographs or team logos served directly from a third party’s content-delivery network). We do not control, endorse, or assume responsibility for third-party content, and your use of it may be subject to the third party’s own terms.

THE SITE AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. The Content is provided for informational and entertainment purposes only and is not betting, wagering, investment, financial, or other professional advice. You are solely responsible for any decisions you make.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR CONTENT, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

You agree to defend, indemnify, and hold harmless Hockey Acumen and its operator from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your Content, or your violation of these Terms or any law or third-party right.

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including a breach of these Terms. Sections that by their nature should survive termination (including IP, restrictions, disclaimers, limitation of liability, indemnification, and governing law) survive.

We may modify, suspend, or discontinue any part of the Site at any time. We may also update these Terms; when we do, we will revise the “Last updated” date. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict-of-laws rules. Before filing any claim, you agree to first contact us and attempt in good faith to resolve the dispute informally. Any dispute not resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in that jurisdiction, and you consent to personal jurisdiction there.

We respect intellectual-property rights. If you believe Content on the Site infringes your copyright, send a notice with the information required by 17 U.S.C. § 512(c)(3) to our designated agent at legal@hockeyacumen.com. We will respond to valid notices as required by law and may remove the material in question.

If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them freely. These Terms (with the Privacy Policy) are the entire agreement between you and us regarding the Site and supersede any prior agreements. Nothing here creates any agency, partnership, or employment relationship.

We designed the Site to collect as little personal information as possible. We do not require you to create an account, and we do not ask for your name, email, or payment details to browse.

Automatically collected. Our hosting and content-delivery provider may log standard technical information (such as IP address, browser type, device, referring page, and pages requested) to operate and secure the Site.

Analytics. We may use privacy-respecting, aggregate analytics to understand overall traffic and feature usage; where used, this data is aggregated and not used to identify you personally.

Preferences stored on your device. We store interface preferences (for example, your selected color theme) in your browser’s local storage. This stays on your device and is not transmitted to us.

We use the limited information above to operate, secure, and improve the Site; understand aggregate usage; prevent abuse, fraud, and scraping; and comply with law. We do not sell your personal information and do not share it with third parties for their own advertising.

The Site may use cookies or similar technologies (including local storage) for essential functionality, to remember your preferences, and for aggregate analytics. You can control or delete these through your browser settings; disabling them may affect some features.

We rely on a small number of third-party services to deliver the Site (such as a hosting/CDN provider) and may load images directly from third-party content-delivery networks. Those parties process information under their own privacy policies, which we do not control.

We retain automatically collected technical and analytics information only as long as reasonably necessary for the purposes described here or as required by law, after which it is deleted or aggregated.

Depending on where you live (for example, under the EU/UK GDPR or the California Consumer Privacy Act), you may have rights to access, correct, delete, or restrict processing of your personal information, to object to processing, and to opt out of the “sale” or “sharing” of personal information. Because we collect very little personal information and do not sell it, these rights may have limited application, but you may contact us to exercise any rights available to you.

The Site is not directed to children under 13 (or the minimum age in your jurisdiction), and we do not knowingly collect their personal information. The Site is operated from the United States; if you access it from elsewhere, your information may be processed in the United States under different data-protection laws than your own.

NHL, the NHL Shield, and the names and logos of the National Hockey League and its member teams are registered trademarks and the property of the NHL and the respective teams. Any such marks shown on the Site are used for identification and informational purposes only.

Hockey Acumen is an independent project and is not affiliated with, endorsed by, or sponsored by the National Hockey League (NHL), the NHL Players’ Association, any NHL team, or any third-party data provider.

The sections below describe services we plan to add. They are placeholders to be completed before each feature launches. Until then, none of the following applies.

Advertising. We do not currently display advertising. [Placeholder] If we introduce ads, this section will name our advertising partner, describe what data they collect (which may include cookies and device identifiers), and link to their privacy policy.

Payments. The Site does not currently process payments. [Placeholder] When paid subscriptions launch, payments will be handled by a third-party payment processor (Stripe). We will not store your full payment-card details; the processor handles them under its own privacy policy. This section will name the processor and link to its policy before any paid plan goes live.

Accounts & authentication. Browsing does not require an account. [Placeholder] When sign-in and subscriptions launch, we will use a third-party authentication/database provider (Supabase) to store account details such as your email, subscription tier, and saved preferences; this section will be completed at that time.
