Terms of Use & Privacy Policy

By accessing, browsing, or otherwise using the Site, you represent that you are at least the age of majority in your jurisdiction (or have a parent/guardian’s consent), that you can form a binding contract, and that you will comply with these Terms and all applicable laws.

• “Content” means all data, statistics, ratings, metrics, models, charts, visualizations, text, design, and other materials made available on the Site.
• “Derived Metrics” means our original analytical outputs (e.g., expected goals, RAPM, GAR, finishing-variance, percentile cards), as distinct from underlying public facts.
• “You” means the individual or entity accessing the Site.

Subject to your continued compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and view the Content for your own personal, non-commercial use only. No other right or license is granted, whether by implication, estoppel, or otherwise. We reserve all rights not expressly granted.

Subscribers. Free-tier browsing is available without an account. If you purchase a paid subscription (see Section 23), your license additionally covers the paid Content included in your subscription tier for the duration of your paid access, on the same personal, non-commercial terms. Your paid access is personal to you and may not be shared, resold, or used on behalf of others; the restrictions in Section 4 apply in full to paid Content.

Except as expressly permitted in writing by us, you agree that you will not, and will not permit any third party or automated agent to:

• sell, rent, lease, sublicense, redistribute, republish, syndicate, or otherwise transfer or make available the Content to any third party; the Content is not for resale;
• scrape, crawl, spider, harvest, bulk-download, cache (beyond ordinary browser caching), or use any automated means, bot, or data-mining tool to access, extract, or copy the Content or any substantial or repeated portion of it;
• use the Content, in whole or in part, to build, train, fine-tune, populate, or operate any product, service, model, dataset, or database that competes with or offers functionality substantially similar to the Site;
• access the Site through any interface other than the one we provide, or use any API, framing, mirroring, or deep-linking to present the Content as your own or out of context;
• reverse engineer, decompile, or attempt to derive the source code, models, or underlying methodology of the Content;
• remove, obscure, or alter any copyright, trademark, attribution, or other proprietary notice;
• circumvent, disable, or interfere with any access control, rate limit, security, or paywall feature;
• impose an unreasonable or disproportionately large load on our infrastructure, or interfere with the proper working of the Site;
• present the Content as official, endorsed by, or sourced from the NHL, NHLPA, any team, or any data provider; or
• use the Site for any unlawful purpose, to provide wagering advice or operate a gambling service, or in violation of any applicable law or third-party right.

Violation of this Section is a material breach that immediately terminates your license. We may investigate and pursue all available remedies, including blocking access and seeking injunctive relief.

The underlying facts reflected in the Content (such as game events, shot coordinates, and contract terms reported publicly) are facts and are not owned by anyone. However, our Derived Metrics, their selection, coordination, and arrangement, and our compilation as a whole are our original intellectual property, protected by applicable law, and are licensed (not sold) to you. All trademarks, logos, and team marks are the property of their respective owners; their appearance on the Site (where applicable) is nominative and does not imply affiliation or endorsement.

The Site may display or link to third-party materials (for example, player photographs or team logos served directly from a third party’s content-delivery network). We do not control, endorse, or assume responsibility for third-party content, and your use of it may be subject to the third party’s own terms.

THE SITE AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. The Content is provided for informational and entertainment purposes only and is not betting, wagering, investment, financial, or other professional advice. You are solely responsible for any decisions you make.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR CONTENT, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

You agree to defend, indemnify, and hold harmless Hockey Acumen and its operator from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your Content, or your violation of these Terms or any law or third-party right.

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including a breach of these Terms. Sections that by their nature should survive termination (including IP, restrictions, disclaimers, limitation of liability, indemnification, and governing law) survive.

We may modify, suspend, or discontinue any part of the Site at any time. We may also update these Terms; when we do, we will revise the “Last updated” date. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict-of-laws rules. Before filing any claim, you agree to first contact us and attempt in good faith to resolve the dispute informally. Any dispute not resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in that jurisdiction, and you consent to personal jurisdiction there.

We respect intellectual-property rights. If you believe Content on the Site infringes your copyright, send a notice with the information required by 17 U.S.C. § 512(c)(3) to our designated agent at legal@hockeyacumen.com. We will respond to valid notices as required by law and may remove the material in question.

If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them freely. These Terms (with the Privacy Policy) are the entire agreement between you and us regarding the Site and supersede any prior agreements. Nothing here creates any agency, partnership, or employment relationship.

We designed the Site to collect as little personal information as possible. Browsing is free and requires no account, and we do not ask for your name, email, or payment details to browse. If you choose to create an account or purchase a subscription, we collect the account and billing information described in Section 23.

Automatically collected. Our hosting and content-delivery provider may log standard technical information (such as IP address, browser type, device, referring page, and pages requested) to operate and secure the Site.

Analytics. We may use privacy-respecting, aggregate analytics to understand overall traffic and feature usage; where used, this data is aggregated and not used to identify you personally.

Preferences stored on your device. We store interface preferences (for example, your selected color theme) in your browser’s local storage. This stays on your device and is not transmitted to us.

We use the limited information above to operate, secure, and improve the Site; understand aggregate usage; prevent abuse, fraud, and scraping; and comply with law. We do not sell your personal information and do not share it with third parties for their own advertising.

The Site may use cookies or similar technologies (including local storage) for essential functionality, to remember your preferences, and for aggregate analytics. You can control or delete these through your browser settings; disabling them may affect some features.

We rely on a small number of third-party services to deliver the Site (such as a hosting/CDN provider) and may load images directly from third-party content-delivery networks. Those parties process information under their own privacy policies, which we do not control.

We retain automatically collected technical and analytics information only as long as reasonably necessary for the purposes described here or as required by law, after which it is deleted or aggregated.

Depending on where you live (for example, under the EU/UK GDPR or the California Consumer Privacy Act), you may have rights to access, correct, delete, or restrict processing of your personal information, to object to processing, and to opt out of the “sale” or “sharing” of personal information. Because we collect very little personal information and do not sell it, these rights may have limited application, but you may contact us to exercise any rights available to you.

The Site is not directed to children under 13 (or the minimum age in your jurisdiction), and we do not knowingly collect their personal information. The Site is operated from the United States; if you access it from elsewhere, your information may be processed in the United States under different data-protection laws than your own.

Team names and logos. NHL, the NHL Shield, and the names, logos, and other marks of the National Hockey League and its member teams are trademarks of the NHL and of those teams, and they own them. We show them only to identify the teams that players and statistics belong to. Team logos load directly from the NHL’s public content-delivery network; we do not keep copies of them.

Player photos. Player photographs belong to the NHL. We show them only so you can recognise the player a card describes. They also load directly from the NHL’s content-delivery network, and a card shows the player’s initials when no photo is available.

Where the statistics come from. The statistics on the Site are built from public sports data: the NHL’s public data feeds, including NHL EDGE, and other publicly available sources. Our Derived Metrics (Section 2) are Hockey Acumen’s own analysis of that data. They are not published, reviewed, or endorsed by the NHL, any team, or any data source.

Hockey Acumen is an independent project and is not affiliated with, endorsed by, or sponsored by the National Hockey League (NHL), the NHL Players’ Association, any NHL team, or any third-party data provider.

The Site offers a free tier and one or more paid subscription tiers. Free browsing requires no account and no payment. The terms in this Section govern paid subscriptions and are part of your agreement with us.

What each tier includes. The free tier provides access to our headline metrics and the most recent seasons. Paid tiers unlock additional Content — including full historical seasons and full-precision analytical outputs — as described on the Site at the time of purchase. We may adjust the specific features included in a tier over time; material reductions to a tier you are actively paying for will be described on the Site.

Price. Paid subscriptions are billed in U.S. dollars at the price shown at checkout. Current plans:

• AAA Tier — $9.99 per month.
• The Big Leagues — $19.99 per month.
• Columbus Fans Tier — $18.99 per month. This plan provides the same access as The Big Leagues at a lower price; it is a pricing option, not a separate feature set.

Beta founder rate. While our beta offer runs, a new AAA Tier, The Big Leagues or Columbus Fans Tier subscription is charged 50% of the monthly price above; the discount is applied automatically at checkout. It lasts for as long as you keep that subscription active. If you cancel and subscribe again after the beta offer has ended, the full price applies.

Applicable taxes may be added. If we change subscription pricing, the new price applies to your next renewal after we notify you; it does not change the price of a billing period you have already paid for.

Billing & automatic renewal. Paid subscriptions are billed monthly, in advance, and automatically renew each month until you cancel. By subscribing, you authorize us and our payment processor to charge your payment method for each billing period until you cancel.

Cancellation. You may cancel at any time, free of charge, from the billing area of your account. Cancellation stops future renewals; your paid access continues until the end of the billing period you have already paid for, and is not renewed after that. We do not charge any cancellation fee.

Refunds. Except where a refund is required by applicable law, all subscription payments are non-refundable, including for partial billing periods and periods of non-use. Cancelling stops future charges but does not refund the current period; you keep access through the end of that paid period as described above.

Payments & card data. Payments are processed by a third-party payment processor. We do not receive or store your full payment-card number; the processor handles card data under its own terms and privacy policy. We receive limited billing information (such as your subscription status, tier, and the payment method’s brand and last four digits) to manage your subscription.

Accounts & authentication. To subscribe you create an account through our third-party authentication and database provider, which stores account details such as your email address, subscription tier, and saved preferences under its own privacy policy. You are responsible for keeping your credentials secure. You may request deletion of your account as described in Section 20.

Support. For billing questions, cancellations you cannot complete yourself, or other subscription support, contact support@hockeyacumen.com.

Service availability. The Site and its Content are provided on an “as available” basis (see Section 7). We do not guarantee uninterrupted access, and occasional downtime for maintenance, updates, or factors outside our control does not by itself entitle you to a refund or credit.

Advertising. The free tier may display advertising; paid tiers are ad-free. Where ads are shown, the advertising provider may collect cookies and device identifiers under its own privacy policy.
